1. Acceptance of Terms
By accessing or using kwayv — AfricaSoulCentral (operated by kwayv Media, “we”, “us”, “our”), you agree to these Terms. kwayv is a pan-African user-generated content platform. If you disagree with any part of these Terms, do not use the platform.
Minimum age: You must be at least 18 years old to register or upload content on kwayv.
2. User Accounts
You are solely responsible for your account credentials and all activity that occurs under your account. Do not share your password with anyone. We reserve the right to suspend or terminate accounts that violate these Terms without prior notice.
3. User-Generated Content
License you grant us: By uploading content, you grant kwayv Media a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, display, distribute and promote your content on the platform and in marketing materials for the duration of your account.
You retain full ownership of all original content you upload. We make no ownership claim over your works.
Prohibited content includes:
- Content infringing copyright, trademarks or other intellectual property rights
- Pornographic, sexually explicit or adult content of any kind
- Hate speech targeting ethnicity, religion, gender, nationality or sexual orientation
- Graphic violence, gore or content glorifying harm or terrorism
- Content involving minors inappropriately — zero tolerance, reported to authorities immediately
- Spam, misleading content or coordinated inauthentic behaviour
- Content violating Nigerian, South African, Ghanaian law or applicable international law
4. Copyright — Nigeria Copyright Act 2022
We comply with the Nigeria Copyright Act 2022. We operate a notice-and-takedown system and use ACRCloud audio fingerprinting at upload to proactively detect copyrighted music.
To file a takedown notice: dmca@kwayvapp.com. We remove infringing content within 48 hours of a valid notice. Three-strikes policy applies: repeat infringers are permanently banned.
5. South African Compliance
We comply with the Electronic Communications and Transactions Act (ECTA) 2002 and Consumer Protection Act 68 of 2008. South African users have the right to cancel subscription services within the cooling-off period prescribed by the CPA.
6. Ghanaian Compliance
We comply with Ghana’s Electronic Communications Act 2008 (Act 775) and the Copyright Act 2005 (Act 690).
7. Prohibited Conduct
- Reverse-engineering, scraping or overloading platform infrastructure
- Impersonating other users, creators or kwayv Media staff
- Distributing malware or phishing content via the platform
- Artificially manipulating view counts, likes or engagement metrics
- Creating multiple accounts to evade bans
8. Content Moderation
Reported content is reviewed within 24 hours. CSAM and terrorism content is immediately reported to law enforcement authorities in Nigeria, South Africa and Ghana.
9. Monetisation
Premium subscriptions are processed via Paystack. Creator revenue distributions are based on actual platform revenue — 80% to eligible creators, 20% to kwayv. We reserve the right to modify monetisation terms with 30 days’ notice.
10. Disclaimer & Limitation of Liability
kwayv is provided “as is” without warranties of any kind. Our maximum liability to you is limited to the greater of: the amount you paid us in the preceding 12 months or ₦5,000. Nothing in these Terms excludes liability for death, personal injury or fraud caused by our negligence.
11. Governing Law & Disputes
These Terms are governed exclusively by the laws of the Federal Republic of Nigeria. Disputes are subject to the exclusive jurisdiction of Nigerian courts. For South African users, the South African Consumer Court has concurrent jurisdiction on consumer protection matters.
12. Changes to These Terms
We may update these Terms at any time. Material changes are notified via email or in-app notice with at least 14 days advance notice. Continued use after that period constitutes acceptance.
